Italian citizenship
Who is entitled:
Italian descendants:
All descendants of Italians have the right to citizenship. However, there is a restriction related to the transmission of citizenship through the maternal line.
If there is a woman in your family tree between your Italian ancestor and you, and she was born before 01/01/1948, you will not be able to pass on citizenship to your descendants.
Examples:
Italian great-grandfather => grandmother born in 1923 => son born in 1950 = This son cannot receive citizenship from his grandmother;
Italian grandmother born in 1948 => daughter born in 1964 = This daughter will be able to receive her grandmother's citizenship.
Why this impediment in Italian law?
Before 01/01/1948 Italy was a kingdom. During this time, only men had the right to transmit citizenship to their children;
From 01/01/1948 on, Italy became a Republic and the right to transfer citizenship started to be exercised by women.
In the offspring by the paternal line there is no restriction on the date of birth. That is, if the family tree is, for example, great-grandfather, grandfather, father and son. Everyone will be able to transmit and receive Italian citizenship regardless of the date they were born.
note:
Several descendants of Italians, who fell within the restriction of the maternal line, constituted a lawyer, went to court in Italy, applied for their right to citizenship, were tried and had their right recognized.
By naturailização:
If the great-grandfather, the grandfather or grandmother, the Italian father or mother, have become naturalized Brazilians, there may be the possibility of recognition of citizenship, provided that the child of this great-grandfather, grandfather or grandmother, father or mother Italians, was born before naturalization.
By marriage:
Women married to Italians or descendants of Italians may apply for Italian citizenship if the marriage took place before April 1983.
Men married to an Italian or of Italian descent will not be entitled to Italian citizenship. Only children common to this couple will be entitled to citizenship.
